Xeplans — Disclaimer and Limitation of Liability

Last updated: 16 October 2026Applies to: every page, document, diagram, figure, download, demonstration and generated output published on xeplans.com or supplied through it.

1. What this disclaimer is

This disclaimer is published by Azam Hashmi ("Xeplans", "we", "us"), an individual in Jeddah, Saudi Arabia, who uses the name "Xeplans", and forms part of our Terms of Service at xeplans.com/terms. Xeplans is not a registered company. Postal address: Al-Safa 1, Jeddah 24381, Saudi Arabia. Google Play shows the account holder's full legal name.

It applies to everything we publish on xeplans.com or supply through it: pages, articles, insights, technical notes, diagrams, figures, specifications, benchmarks, code samples, downloads, demonstrations, tools, and any output produced by a system on the site.

By reading or using that material you accept this disclaimer. If you do not accept it, do not rely on the material.

2. General information only — this is not professional advice

Everything we publish is general information. It is not advice, and it is not a substitute for advice.

Nothing on the site constitutes, and nothing on it may be relied on as, professional engineering advice, architectural or structural advice, safety or risk advice, information security advice, legal advice, regulatory or compliance advice, tax advice, accounting advice, financial or investment advice, medical advice, or advice of any other regulated or professional kind.

No professional relationship is created by your reading the site, by your downloading anything from it, by your sending us a brief, or by our replying to you. No engineer-client, adviser-client, consultant-client or fiduciary relationship arises unless and until a written agreement is signed by both parties.

Take your own advice. Before you act on anything published here, obtain advice from a qualified professional who is licensed in your jurisdiction and who knows your specific facts, your site conditions, your regulatory regime and your risk tolerance. Never disregard or delay professional advice because of something you read on this site.

3. Accuracy, completeness and currency

We prepare what we publish with reasonable care, but:

  • the material may contain errors, omissions, simplifications or typographical mistakes;
  • it states a position at the date of publication, and standards, regulations, prices, products, dependencies and best practice change. We are under no obligation to update anything, and a page carrying an older date may be out of date;
  • material is written for a general audience and takes no account of your circumstances, requirements, constraints or applicable local rules;
  • figures, benchmarks, performance numbers and timescales are indicative, obtained under particular conditions, and will not necessarily be reproduced in your environment.

We give no warranty that anything published is accurate, complete, current, reliable or suitable for any purpose.

4. Engineering, technical and safety material

Technical material — control schemes, architectures, circuits, calculations, tolerances, settings, parameters, code, configurations and procedures — is published to explain an approach, not to be applied unchecked.

It must be independently verified, calculated, reviewed and tested by a competent qualified person for your actual application before it is used. It is not a design, a specification, a certification, a calibration or a sign-off, and it is not a substitute for the manufacturer's data, the governing standard, the applicable code, or a site-specific risk assessment.

Do not use anything published on this site in any safety-critical, life-support, medical, aviation, marine, rail, automotive, nuclear, defence, industrial-control or critical-infrastructure application, or in any other application where a failure, an error or a delay could cause death, personal injury, or severe physical, environmental or financial damage. If you do so anyway, you do so entirely at your own risk and you accept full responsibility for it.

Hardware and physical systems never behave exactly as an ideal model predicts. Tolerances, drift, wear, environment and calibration are yours to establish and maintain.

5. Artificial intelligence and generated output

Where a page, a tool or a service on the site produces output using an artificial intelligence or machine-learning system:

  • the output is generated and probabilistic. It can be wrong, incomplete, out of date, internally inconsistent or entirely fabricated, and it can be all of those while appearing fluent and confident;
  • it is not reviewed by a human before you see it unless we say so;
  • it may reflect bias or error present in the data a model was trained on;
  • it is not advice of any kind and creates no professional relationship;
  • you must verify it independently before acting on it, and every decision you take on it remains yours;
  • we make no warranty as to its accuracy, reliability, fitness for purpose, originality, or non-infringement of any third-party right;
  • to the fullest extent permitted by law, we exclude all liability for any loss arising from reliance on generated output.

Where a law requires us to disclose that you are interacting with an artificial intelligence system, or to mark generated content as generated, we make that disclosure on the page concerned.

6. Forward-looking statements

Statements about plans, intentions, roadmaps, capabilities under development, expected performance, markets or future results are forward-looking. They rest on assumptions and on information available when written, they involve known and unknown risks, and actual results may differ materially. Nothing forward-looking is a promise, a commitment, a guarantee or a representation that anything will be delivered, released, supported or achieved. We are under no obligation to update a forward-looking statement.

7. Work shown, examples and results

Work, projects, capabilities and examples shown on the site describe what was done in a particular context for a particular client. Nothing shown is a representation that a similar result can be achieved for you. Every outcome depends on facts we do not control: your requirements, your data, your systems, your team, your budget, your timescale and your market. Where an example is illustrative rather than a real engagement, the page says so.

The site may link to, quote, embed or describe material and services belonging to others. We do not control them and we do not endorse them by linking. We accept no responsibility for any third-party content, product, service, availability, security or privacy practice, and any dealing you have with a third party is between you and them. Any third-party name or mark shown is used for identification only and belongs to its owner.

9. No offer, no solicitation, no investment advice

Nothing on the site is an offer to sell or a solicitation of an offer to buy any security, interest, instrument or asset, in any jurisdiction, to any person. Nothing on it is investment, financial or trading advice, a recommendation, or an assessment of suitability, and nothing on it should be used as the basis of an investment decision. We are not a licensed financial adviser, broker or investment firm. Where an item on the site concerns a venture, a product or a market, it is descriptive only.

10. Availability, security and loss of data

We give no service level, uptime commitment or support commitment for the site. It may be unavailable, interrupted, withdrawn or changed at any time without notice. Internet transmission is never perfectly secure, and email is not a confidential channel. You are responsible for your own backups, your own antivirus protection and your own security controls, and we accept no liability for loss or corruption of your data, for any malicious code, or for any unauthorised access that does not result from our breach of a duty we owe you.

11. "As is" — disclaimer of warranties

To the fullest extent permitted by applicable law, everything on the site is provided "as is" and "as available", with no warranty of any kind, express, implied or statutory.

We disclaim the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, quiet enjoyment and non-infringement, and any warranty arising from a course of dealing or usage of trade. No advice or information, oral or written, obtained from us or through the site creates any warranty not expressly stated in writing and signed by us.

12. Limitation of liability

Nothing in this disclaimer excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that the applicable law does not permit to be excluded or limited.

Subject to that, and to the fullest extent permitted by applicable law:

  • you use the site and rely on its material entirely at your own risk;
  • we exclude all liability for any loss or damage — direct or indirect, incidental, special, consequential, exemplary or punitive — arising out of or in connection with the site, its material, its unavailability, any error or omission in it, any generated output, or any action you take or fail to take in reliance on it;
  • we exclude in particular liability for loss of profit, revenue, business, contracts, production, anticipated savings, goodwill, reputation, opportunity, data or data use, and for the cost of procuring substitute services — whether or not foreseeable, and whether the claim lies in contract, tort including negligence, breach of statutory duty, misrepresentation, restitution or otherwise;
  • our total aggregate liability in connection with the site and this disclaimer, for all claims taken together, is limited to the greater of the total amount you paid us for the site in the 12 months before the event giving rise to the claim, and one hundred United States dollars (USD 100). Where a paid engagement exists, the limit in section 16 of the Terms of Sale applies to that engagement instead;
  • these limits apply even if a remedy fails of its essential purpose, and they survive any termination.

The site is provided free of charge. These limits are the basis on which we publish it, and without them we would not publish it.

13. Time limit for claims

A claim must be brought within the period the applicable law sets. Under Saudi law, the parties cannot shorten or lengthen that period by agreement.

14. Where the law does not allow an exclusion

Some jurisdictions do not allow the exclusion of certain warranties, the exclusion or limitation of certain damages, or a shortened limitation period. If you live in such a jurisdiction, some or all of sections 11, 12 and 13 may not apply to you, and our liability is limited to the smallest extent that law permits. Nothing in this disclaimer affects the non-excludable statutory rights of a consumer, including any consumer guarantee, and nothing in it limits any right you have under a mandatory rule of the law of the country where you habitually reside.

15. Governing law and disputes

This disclaimer is governed by the laws of the Kingdom of Saudi Arabia, and any dispute is resolved as section 19 of the Terms of Service sets out, with the carve-outs stated there for urgent injunctive relief, small claims and consumers. A consumer may always bring proceedings in the courts of the country where they habitually reside.
