1. Who we are and who you are
NAWWIR ("the app") is operated by Xeplans, Inc., a company being registered in the United States ("we", "us", "the operator"). Its registration number and registered address will be published here once registration completes. Contact: support@xeplans.com. We do not operate a telephone line; email is the way to reach us.
"You" means the natural person using the app. Accounts are for individuals; a business may use the app only as a venue partner under section 15.
By creating an account you accept these terms, the Community Guidelines (section 5) and the Privacy Policy. Each is shown to you before your account is created, and you tick each one separately. If you do not accept them, do not use the app.
2. You must be 18 or older
The app is for adults only. You confirm that you are at least 18 years old (or the age of majority where you live, if higher). We check your year of birth when you sign up and ask you to declare your age. We close any account we believe belongs to a person under 18, without notice.
3. What NAWWIR is, and what it is not
NAWWIR lets people post group activities and lets other people ask to join. The host of an activity decides who joins.
We are a noticeboard, not an organiser. We do not run, supervise, attend, insure or take part in any activity posted on the app. Activities are arranged between users themselves, in places we do not control.
We do not check anyone. We do not perform identity verification, background checks, criminal-record checks or any other screening of users. A profile tells you only what that person chose to type, plus the attendance counts described in section 7.
NAWWIR is not a dating service. It is for group activities. Using it to seek romantic or sexual encounters is a breach of section 5.
4. Meeting other people — read this carefully
You meet other people entirely at your own risk.
You alone decide whether to meet anyone, where, and what to do there. You accept that:
- other people may not be who they claim to be;
- other people may behave badly, dishonestly or dangerously;
- an activity may be unsafe, cancelled, or nothing like its description;
- physical activities carry a risk of injury;
- we have no control over what happens when people meet.
To the fullest extent permitted by law, we are not responsible for the conduct of any user, online or in person, nor for any injury, loss, damage or distress arising from any meeting, activity or interaction arranged through the app.
Sensible precautions we strongly recommend: meet in public places, tell somebody where you are going, arrange your own transport, do not share your home address, keep your own valuables and documents with you, and leave at once if you feel uncomfortable. If you are in danger, call the police.
5. Conduct: zero tolerance for abuse and objectionable content
There is no tolerance for objectionable content or abusive users on NAWWIR. The Community Guidelines (xeplans.com/nawwir/guidelines, and in the app under Settings → Legal) form part of these terms and spell the rules out in plain words. In summary, you must not post, send, or do any of the following:
- harassment, threats, bullying, stalking or intimidation;
- sexual content, sexual solicitation, or content that sexualises anyone;
- anything involving a person under 18 in a sexual context. This is reported
to the authorities;
- hateful, discriminatory or abusive content toward any person or group,
including on grounds of religion, sect, nationality, ethnicity, gender or disability;
- violence, threats of violence, or encouragement of violence or self-harm;
- content or activities that are illegal in the Kingdom of Saudi Arabia,
including under the Anti-Cyber Crime Law and the Anti-Harassment Law;
- content that offends public order, public morals or religious values;
- fraud, scams, pyramid schemes, or requests for money;
- impersonating any person or organisation, or a fake profile;
- spam, advertising or commercial promotion without our written permission;
- collecting, publishing or misusing other users' personal information,
including screenshots of chats or meeting points shared outside the app;
- activities involving alcohol, drugs, gambling or weapons, or anything else
unlawful in the Kingdom;
- attempts to bypass safety features, including creating a new account after
suspension, or accessing the service by any means other than the app.
How we enforce this
- Every user can report any user, activity or message from inside the app,
without leaving it, and can block any user instantly. Blocking hides you from each other everywhere in the app.
- We review reports and normally act within 24 hours.
- We may remove content, cancel an activity, suspend an account for a fixed
period, or remove a user permanently, with or without notice.
- We may report unlawful conduct to the competent authorities and cooperate
with them.
- When we suspend you, the app tells you so, for how long, and how to appeal.
You may appeal by email to support@xeplans.com within 30 days, and a person will review the decision. Suspended users can still read, and can still report others.
Removing your access is at our discretion and gives no right to compensation.
6. Your account
You are responsible for everything done through your account. Keep your sign-in email and any password secure, and tell us at once if you believe someone else has used your account.
You may hold one account only. You may not sell, share or transfer it. You must give accurate information about yourself and keep it current; in particular your gender and year of birth decide which activities you may see and join, and a false declaration is a breach of these terms.
7. Hosting, joining and attendance
If you host an activity, you must describe it truthfully, decide join requests fairly and promptly, and cancel it in the app if it will not happen, giving a reason. You are responsible for the people you approve. A host may restrict an activity to men only or women only; the app then hides it from the other gender. This is a standard feature for the Saudi market and hosts may not use it for any other discriminatory purpose.
If you join, turn up when you have been approved, or leave the activity in the app in good time.
Attendance counts. After an activity the host marks who attended. The number of activities you attended, missed and hosted is shown on your profile so that others can judge reliability. The counts are maintained automatically; neither you nor the host can edit them. If you believe a mark is wrong, email support@xeplans.com.
8. Your content
You keep ownership of what you write. By posting it you give us a non-exclusive, worldwide, royalty-free licence to store, display, transmit, translate for display and back up that content, solely so the app can work and so we can moderate it. The licence ends when the content is deleted, except for copies kept as safety records under the Privacy Policy.
You confirm you have the right to post everything you post and that it does not infringe anyone's rights. We may remove any content at any time without notice, and we are not obliged to store or return it.
If you send us ideas or feedback, we may use them without obligation to you.
9. Free to use, and subject to change
The app is free. If we ever introduce charges, we will tell you in advance and any paid feature will be clearly marked; nothing you already have becomes paid without your agreement.
We may change, suspend or discontinue any part of the app at any time. If we change these terms in a way that matters, we will show you the new version in the app and ask you to accept it before you continue. The version you accepted is always visible in Settings → What you agreed to.
10. Licence to use the app
We grant you a personal, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, in accordance with these terms and the app store's usage rules. You may not copy, modify, reverse-engineer, scrape, or interfere with the app or its servers, or use automated tools against them. All rights in the app, its name, logo and design belong to us or our licensors.
The app includes third-party components under their own licences; you agree to comply with any third-party terms that apply to your use.
11. Availability — no guarantee
The app is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or secure, that any information in it is accurate, that anyone will join your activity, or that any activity will take place.
12. Limitation of liability
To the fullest extent permitted by the laws of the Kingdom of Saudi Arabia:
- we are not liable for indirect, incidental, special or consequential loss,
including lost profit, lost opportunity or loss of data;
- we are not liable for the acts or omissions of any user or venue;
- our total liability to you for all claims together is limited to the greater
of (a) the amounts you paid us in the twelve months before the claim, or (b) SAR 500.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our own negligence, for fraud or gross negligence, or for anything else Saudi law does not permit us to exclude. Where local law does not allow an exclusion above, our liability is limited to the smallest amount that law allows.
13. You cover us for what you do
You agree to indemnify and hold harmless the operator, its owners, employees, moderators and partners against any claim, loss or expense (including reasonable legal fees) arising from your use of the app, your content, your conduct toward other users or venues, or your breach of these terms.
14. Ending your use
You may stop using the app at any time and delete your account in the app (Profile → Settings → Delete my account), on the web (xeplans.com/nawwir/delete-account), or by writing to support@xeplans.com. What is deleted and what is kept is set out in the Privacy Policy.
We may suspend or end your access at any time for a breach of these terms, and in particular of section 5.
Sections 4, 8, 12, 13, 16, 17 and 18 survive the ending of your account.
15. Venue partners
Cafés and other businesses may publish public events on NAWWIR as venue partners. A venue account is created by us under the separate Venue Partner Terms, which govern that business. When you attend a venue event you accept that its address is public and that the venue sees the same about attendees as a host sees about approved members. The venue, not we, is responsible for its premises, and section 4 applies to venue events as to any other activity.
16. Governing law and disputes
These terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute is subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia. Before going to court, please write to us; most problems can be resolved in a few days.
If you use the app as a consumer in a country whose mandatory consumer law gives you rights that this section cannot take away, those rights are not affected. Nothing in these terms limits your right to bring a claim in your country of residence where that law grants it.
If any part of these terms is found unenforceable, the rest continues to apply. These terms, the Community Guidelines and the Privacy Policy are the whole agreement between you and us about the app. They exist in Arabic and English; both are authentic, and in case of conflict the Arabic version prevails for users in the Kingdom of Saudi Arabia.
17. Apple App Store — additional terms
Where you obtained the app from the Apple App Store:
- Acknowledgement. These terms are between you and the operator only, not
with Apple. The operator, not Apple, is solely responsible for the app and its content.
- Scope of licence. Your licence is a non-transferable licence to use the
app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. The operator is solely responsible for any
maintenance and support. Apple has no obligation to furnish any maintenance or support services for the app.
- Warranty. To the extent any warranty exists and is not disclaimed, the
operator is responsible for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the operator's responsibility.
- Product claims. The operator, not Apple, is responsible for addressing
any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that the app or your
possession and use of it infringes that third party's intellectual property rights, the operator, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance. You represent and warrant that you are not located in a
country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Xeplans, Inc., registration in the United States
pending; registered address published in section 1 once registration completes; email support@xeplans.com; no telephone line.
- Third-party terms. You must comply with applicable third-party terms of
agreement when using the app.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party
beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.
